v02 Legal Analysis Generation Plan ​

Approach ​

Unlike v01 (which built from scratch with 4 parallel research agents), v02 takes a correction-and-expansion approach. We already have a solid v01 base; the goal is to fix verified errors, fill identified gaps, explore new angles to strengthen the mother's position, and produce an updated analysis plus Czech translation.

Key constraints:

  • Never modify v01 files
  • Never mention v01 mistakes in analysis/v02_legal_analysis.md
  • Documenting corrections in research/v02/ files is allowed and recommended
  • German legal/formal terms must always appear in original language with translations (in both EN and CZ versions)
  • Follow same source reference convention (sources_inventory.md, <sup> tags, Sources sections)

Phase 1: Document v01 Validation Findings ​

Step 1: Create research/v02/00_v01_validation_report.md ​

Document all issues found in the validation of v01 research. This is an internal reference for subsequent steps. Key findings to document:

Statutory law errors:

  • Section 9(4) StVO: content described is actually from Section 9(3); real Section 9(4) covers opposing left/right-turners
  • Section 14 VVG: wrong term "Vorschusszahlungen" -- statute says "Abschlagszahlungen"; mischaracterized as processing obligation vs. maturity rule (Falligkeitsregelung)
  • Section 56(2) OWiG: one-week period is payment deadline, not issuance deadline
  • Section 11(1) StVO: phrase "thereby obstructing cross-traffic" added to statute text; oversimplified as sole Kreuzungsräumer basis (case-law-driven doctrine)

Case law errors:

  • OLG Nurnberg 3 U 746/24: fundamentally mischaracterized -- it is a Section 9 StVO left-turner vs. right-turner case (50:50), NOT a Kreuzungsräumer case
  • KG Berlin 22 U 176/17: "50/50 baseline" and "100% clearer if no attempt to verify" subclaims not verifiable from available sources
  • OLG ZweibrĂĽcken 1 U 18/20: likely mischaracterized as green-arrow case; cross-references suggest standard Kreuzungsräumer
  • OLG Hamm 7 U 22/19: no URL, no cross-references, unverifiable
  • OLG Hamm 7 U 22/16: "approximately 40 seconds" not corroborated by cited source (source says ">20 seconds red")

Insurance errors:

  • Section 1a VVG: mischaracterized as "duty of loyalty / Treu und Glauben" -- actual title is "Vertriebstatigkeit des Versicherers" (distribution activity)
  • 300,000 backlog: was SchriftstĂĽcke (correspondence), not claims -- materially overstated
  • Forsa respondents: "Verkehrsanwalte" (AG members), not "Fachanwalte fur Verkehrsrecht" (certified specialists)
  • AKB hosted on vpv.de, not huk.de -- should cross-check

Practical errors:

  • FB61 designation: actual name is "Stadt- und Verkehrsplanung", not "Tiefbau"
  • PP Krefeld Direktion Verkehr: actual address is Hansastrasse 25, 47799 Krefeld (not Nordwall 1-3, 47798)

Phase 2: Corrected Research (4 parallel agents + review) ​

Step 2: research/v02/01_statutory_law.md -- Corrected Statutory Provisions ​

Re-verify all 11 provisions. Key corrections:

  • Fix Section 9(4) description to match actual statute (opposing left/right-turners)
  • Fix Section 14 VVG: correct term to "Abschlagszahlungen", characterize as Falligkeitsregelung
  • Clarify Section 56(2) OWiG one-week period as payment deadline
  • Nuance Section 11(1) as part of Kreuzungsräumer framework (not sole basis)
  • Add Section 115 VVG (Direktanspruch -- direct claim of injured party against liability insurer) as a new provision, since the family's claim is against Neumann's insurer directly

Step 3: research/v02/02_case_law.md -- Corrected and Expanded Case Law ​

Re-verify all rulings. Key actions:

  • Remove or correct OLG Nurnberg 3 U 746/24 -- document that it is NOT a Kreuzungsräumer case
  • Re-research OLG Hamm 7 U 22/19 -- attempt to find URL or cross-reference; if unverifiable, downgrade confidence or remove
  • Re-research OLG ZweibrĂĽcken 1 U 18/20 -- correct characterization based on cross-reference evidence
  • Tighten KG Berlin 22 U 176/17 claims -- only assert what is verifiable from sources
  • Search for new 2025-2026 case law on Kreuzungsräumer, RotlichtverstoĂź, NachzĂĽgler (web search on dejure.org, beck-online.de, juris)
  • Verify "~40 seconds" claim for OLG Hamm 7 U 22/16 -- try to access full ruling text

Step 4: research/v02/03_insurance.md -- Corrected Insurance Research ​

Key actions:

  • Fix Section 1a VVG characterization -- correct from "Treu und Glauben" to "Vertriebstatigkeit"
  • Fix 300,000 figure -- clarify as SchriftstĂĽcke, not claims
  • Fix Forsa respondent description -- "Verkehrsanwalte" not "Fachanwalte"
  • Fix terminology -- "Abschlagszahlungen" not "Vorschusszahlungen"
  • Cross-verify AKB against HUK-COBURG direct source (try huk.de)
  • Verify truncated AKB clauses E.1.1, E.2, E.7.3 -- attempt to access full AKB text
  • Add Section 115 VVG research (Direktanspruch) for direct claim against insurer
  • Check for updated Ombudsmann or BaFin data (2025 annual report if available)

Step 5: research/v02/04_commentary_and_practical.md -- Corrected Practical Research ​

Key actions:

  • Fix FB61 designation to "Stadt- und Verkehrsplanung"
  • Fix PP Krefeld Direktion Verkehr address to Hansastrasse 25, 47799 Krefeld
  • Add Google Street View / Maps analysis of the intersection -- verify signal type, stop line visibility, sightlines from available imagery
  • Research weather conditions on 04.02.2026 in Krefeld (visibility, precipitation could be relevant)
  • Research Krefeld-specific traffic engineering -- check if signal timing plans are published online or if IFG NRW requests have precedent
  • Add template letters for Signalzeitenplan request and Akteneinsicht request (practical value for the family)

Phase 3: New Research Angles ​

Step 6: Additional Research to Strengthen the Mother's Case ​

Explore these new angles via web research:

  • Section 315c StGB (dangerous intervention in road traffic): Could Neumann's conduct (driving off without looking at an intersection signal on red) rise to criminal endangerment? Even if not pursued, mentioning this provision in correspondence with HUK-COBURG adds pressure.
  • Dashcam / traffic camera coverage: Research whether Krefeld has CCTV or traffic monitoring at this intersection. Some NRW cities have traffic cameras at signalised intersections.
  • Unfallrekonstruktion (accident reconstruction): Research standards for independent accident reconstruction experts in the Krefeld area. A reconstruction could establish speeds, angles, and reaction times.
  • BGH recent decisions on Betriebsgefahr displacement: Check for any 2025-2026 BGH rulings refining when Betriebsgefahr recedes entirely.
  • Check Haufe zfs article: The Haufe article on Kreuzungsräumer references Section 11(3) StVO -- research whether legal commentary is split on Section 11(1) vs Section 11(3) as the correct basis, and document both views.

Step 7: research/v02/05_consolidated_brief.md -- Cross-Referenced Review ​

Sequential review agent reads all v02 research outputs and produces:

  • Cross-referenced assertions with confidence ratings
  • Corrections from v01 documented (for internal reference)
  • Updated gap analysis
  • Updated key verified assertions (Tier 1/2/3)
  • Recommendations for the analysis

Phase 4: Analysis Writing ​

Step 8: research/v02/sources_inventory.md -- Master Source List ​

Compile all source URLs from v02 research into master inventory. Include any new sources discovered. Follow same slug-based format as v01.

Write Part One: Detailed Summary of the Situation

  • Factual summary, intersection layout, legal framework, liability scenarios, risk assessment
  • Incorporate corrected statutory provisions and case law
  • Use only VERIFIED assertions from the consolidated brief
  • Do not mention v01 errors -- present corrected information as authoritative
  • All German legal terms in original with English translation on first use

Write Part Two: Actions Without a Lawyer

  • Verwarnung response, evidence gathering, insurance dealings, escalation paths
  • Incorporate corrected practical information (correct addresses, correct terminology)
  • Include template language for Signalzeitenplan request and Akteneinsicht request
  • Updated checklist with corrected deadlines and contacts

Write Part Three: Actions Involving a Lawyer

  • Three-tier legal strategy, OWi proceedings, civil claim, costs, HUK tactics
  • Incorporate any new case law found
  • Updated case law reference table with corrected and expanded entries
  • Incorporate any new arguments discovered in Phase 3

Add markdown reference-style links (<sup> tags + Sources section) to the complete analysis. Cross-check against sources_inventory.md.

Phase 5: Czech Translation ​

Translate the complete v02 analysis to Czech. Convention:

  • All German legal and formal terms appear in original German with Czech translation in square brackets on first use
  • Example: "pisemne upozorneni s pokutou [Schriftliche Verwarnung mit Verwarnungsgeld]"
  • After first introduction, the German term may be used alone
  • Statute names stay in German (StVO, StVG, OWiG, BGB, VVG)
  • Same source references as English version (URLs are language-independent)
  • Same structure (3 parts, sources section, disclaimer)

Phase 6: Final Review ​

Step 14: Final Review of All v02 Documents ​

Review agent checks:

  • All citations in analysis match consolidated brief
  • All sources in analysis appear in sources_inventory.md
  • German term formatting is consistent across both language versions
  • No v01 errors are mentioned in the analysis
  • Czech translation is accurate and complete
  • All URLs are functional
